1.- Ownership of the Website

In accordance with the provisions of Article 10 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce ('LISS') we hereby inform you that the website www.espadasdetoledo.com (the 'Website') is owned and maintained by Artesanía Tradicional Toledana S.L. ('ATT'), with company tax ID C.I.F. B-45831534, registered at the Commercial Registry of Toledo, and registered office at C/ Amapola nº 38, Azucaica, Toledo.

2.‐ Use of the Website

This legal notice ('Legal Notice') sets out the conditions governing the use of information society services that ATT makes available to Internet users through the Website.

Access to and use of the Website implies that the user of the Website (the 'User') fully accepts and undertakes to comply completely with this Legal Notice as well as any instructions or recommendations indicated in specific conditions on the Website.

Access to the Website is provided free of charge, except as regards connection charges incurred by the User for access to their contracted ISP's telecommunications network.

ATT reserves the right, at any time and without prior notice, to modify and update the Website and its contents, configuration and presentation, including this Legal Notice. We therefore recommend that the User reads this every time they access and browse the Website.

The User must not use the Website for fraudulent purposes, or behave in any way that might damage the image, interests and rights of ATT or third parties, and must use the Website and its services and contents in a duly proper and lawful manner. In particular, the User must not remove, circumvent or interfere with the copyright or other information identifying ATT's' rights incorporated in the contents of the Website, nor any technical protection devices or information mechanisms that might include such content. Likewise, the User undertakes not to perform any act with the aim of damaging, disabling or overloading the Website, or that would in any way hinder its normal use and operation.

In the event that the User fails to comply with this Legal Notice, or ATT has reasonable suspicion that they are in breach of it, ATT reserves the right to restrict, suspend, or terminate the User's access to the Website, by adopting any technical measure that is necessary for this purpose. ATT also reserves the right to determine, at any time, the continuation of the services it provides through the Website.

3.‐ Intellectual and Industrial Property

Intellectual property rights covering the layout of the Website's content (including the sui generis database right), graphic design (look and feel), distinctive signs (trademarks and trade names), the operating software (including source code), as well as the different elements that make up the Website (texts, graphics, photographs, videos, etc.) correspond to ATT or in certain cases to their specific rights of usage, and in this regard they constitute work protected by the intellectual and industrial property legislation in force.

The User's use of the Website does not in a any way involve the assignment of any intellectual and/or industrial property rights for the site, its contents and/or ATT's distinctive signs. To this end, by means of this Legal Notice, the User is expressly forbidden to reproduce, transform, distribute, publicly disseminate, make available, extract and/or reuse the Website, its contents and/or ATT's distinctive signs, except in those cases where it is legally permitted.

The reproduction of Website content or elements for profit or commercial purposes is expressly and strictly prohibited.

4.‐ Limitation of Liability

The User acknowledges and accepts that the use of the Website is at all times at their sole risk and responsibility, and thus ATT shall not be held liable for the misuse of the Website. To this end, ATT shall only be liable for any damage the User may incur through the use of the Website where such damage is caused by our wrongful action.

In particular, ATT shall not be liable for:

-         The content of websites accessed through the links included on the Website. In this regard, the terms set out in Section 5 of this Legal Notice will be applicable.

-         Damage or loss of any kind caused to the User's computers by viruses, worms, Trojan horses or other malicious software. The User acknowledges that use of the Internet carries a risk that their computer may be affected by such software. For this purpose and in all cases, it is the User's responsibility to equip themselves with appropriate tools for the detection and removal of malicious software.

-         Damage or loss of any kind caused to the User from failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of Website service during or prior to its provision. In this regard, the User acknowledges that access to the Website requires services provided by third parties beyond the control of ATT.

5.- Links

The Website includes hyperlink devices (links) that allow the User to access other websites and web pages ('Linked Sites'). In these cases, ATT acts as an intermediary service provider in accordance with Article 17 of the LISS, and will only be liable for contents and services provided on the Linked Sites to the extent that it is aware of wrongdoing and has not duly disabled the link. In the event that the User considers that a Linked Site is hosting unlawful or inappropriate content, they should please notify ATT through the contact form. This communication will not entail any obligation to remove the corresponding link.

The existence of Linked Sites does not in any way imply that ATT has actual or any other type of knowledge about their services and contents in the case of wrongdoing, nor that it necessarily has agreements with those responsible for the Linked Sites. Neither does the existence of such links imply ATT's recommendation, promotion, identification or agreement with statements, contents or services provided by the Linked Sites. Consequently, ATT is not responsible for the content of the Linked Sites or their terms and conditions of use and privacy policies; the User is solely responsible for checking and accepting these conditions whenever they access and use these sites.

The User and, in general any natural or legal person who proposes to create a link from their web page or website, must obtain prior written permission from ATT. The creation of such a link does not in any case entail the existence of a relationship between ATT and those responsible for the website or page where the link is created, nor ATT's acceptance or approval of its contents or services.

6.- General Information

The use of the Website is governed by and construed in accordance with Spanish law and it shall be understood that by using the Website the User agrees that any dispute or litigation arising between the User and ATT will be settled under the jurisdiction of the Toledo courts.

In the event that any provision contained in this Legal Notice is declared invalid, it will be duly removed or replaced. Such invalidity shall not in any case affect the validity of the remaining provisions of this Legal Notice.

In accordance with the provisions of Law 15/1999 of 13 December on Personal Data Protection (LPDP) and its implementing regulations, we inform you that the data you provide when you register on the website www.espadasdetoledo.com (the Website), as well as data gathered through the business relationship and/or delivery of products purchased via the Website, will be incorporated into a file duly registered in the Spanish Data Protection Agency General Registry, at the responsibility of Artesanía Tradicional Toledana S.L. ('ATT'), with company tax ID C.I.F. B-45831534 and registered office at C/ Amapola nº 38, Azucaica, Toledo.

Unless specifically stated otherwise, all information that we request during the registration process and in the submission forms on www.espadasdetoledo.com is obligatory, such that any omission might make it impossible for us to provide the services requested and/or respond to your requests.
